นโยบายความเป็นส่วนตัวสำหรับผู้เข้าร่วมกิจกรรม Research Challenge (Research Challenge Privacy Notice)
CFA Society Thailand (“CFA Society Thailand”) ในฐานะผู้จัดการแข่งขัน CFA Institute Research Challenge in Thailand (“กิจกรรม”) ขอแจ้งให้ท่านที่สนใจเข้าร่วมกิจกรรม ทราบว่า ในการจัดกิจกรรมครั้งนี้ CFA Society Thailand มีความจำเป็นต้องเก็บ รวบรวมข้อมูลส่วนบุคคลของท่านก่อน ระหว่างและภายหลังการจัดกิจกรรม
ข้อมูลส่วนบุคคลที่จะมีการประมวลผล รวมมีข้อมูลส่วนบุคคลของสมาชิกทุกคนและในทีมงานของท่านที่เข้าร่วมกิจกรรม ได้แก่ (1) ชื่อนามสกุล (2) ข้อมูลประวัติย่อที่รวมมาใน Resume ของทีมงานแต่ละคนเพื่อแสดงประวัติการศึกษา ประวัติการทำงาน คุณสมบัติการฝึกอบรมต่างๆ ทั้งหมดที่เกี่ยวข้องของทีมงานแต่ละบุคคล (3) ข้อมูลการติดต่อ (เช่น เบอร์โทรศัพท์หรืออีเมล) (4) ข้อ มูลส่วนบุคคลอื่นที่ท่านอาจให้แก่ CFA Society Thailand ผ่านแบบฟอร์มการลงทะเบียน หรือแบบฟอร์มใบสมัคร (5) ภาพถ่าย ทั้งที่เป็นภาพนิ่ง และภาพเคลื่อนไหวในการเข้าร่วมกิจกรรมและภาพการรับรางวัล ทั้งที่เป็นในลักษณะการอัดและถ่ายทอดสด และการบันทึกไว้ล่วงหน้า ทั้งนี้ผู้เข้าร่วมกิจกรรมต้องรับทราบว่า ภาพถ่ายและภาพเคลื่อนไหวดังกล่าวจะได้รับการเผยแพร่และเปิดเผยเป็นสาธารณะ เพื่อรับประกันความโปร่งใสในการจัดกิจกรรม และ (6) กรณีที่ท่านได้รับรางวัลชนะเลิศ ทาง CFA Society Thailand จำเป็นต้องเก็บ รวบรวมข้อมูลส่วนบุคคลได้แก่ ข้อมูลหนังสือยืนยันตัวตนของผู้เข้าร่วมกิจกรรมที่ชนะรางวัล ไว้ประกอบหลักฐานการให้รางวัล
ทั้งนี้โดยเฉพาะสำหรับภาพถ่ายในการเข้าร่วมกิจกรรม หากท่านไม่ต้องการให้มีการบันทึกภาพ ท่านสามารถแจ้งจุดประสงค์ของท่านได้ที่พนักงานของ CFA Society Thailand ทราบ หรือสามารถแสดงเจตนาอย่างชัดเจนในการปฏิเสธการถ่ายภาพดังกล่าวได้ แต่ทั้งนี้สิทธิในการคัดค้านหรือปฏิเสธดังกล่าว ไม่รวมไปถึงภาพเคลื่อนไหว และเสียงที่ได้รับการบันทึกไว้ระหว่างการประกวด (เช่น Audition VDO หรือ Pitch VDO) ซึ่งจำเป็นต้องบันทึกและจัดทำขึ้นเพื่อเป็นส่วนหนึ่งในการพิจารณาความเหมาะสม ในการรับรางวัลจากการแข่งขันที่ CFA Society Thailand จัดขึ้น ซึ่งถือเป็นการจัดเก็บข้อมูลส่วนบุคคลที่มีความสำคัญและจำเป็นสำหรับการดำเนินกิจกรรม ซึ่งท่านผู้เข้าร่วมกิจกรรมจำเป็นต้องให้ CFA Society Thailand เก็บ รวบรวม ประมวลผล ใช้และเผยแพร่ ในฐานะที่เป็นส่วนหนึ่งของเงื่อนไขสำคัญการเข้าร่วมกิจกรรม
จุดประสงค์ในการประมวลผลข้อมูลส่วนบุคคล CFA Society Thailand มีความจำเป็นต้องเก็บรวบรวมข้อมูลส่วนบุคคลตามที่ระบุไว้ เพื่อจุดประสงค์ ดังนี้ (1) การพิจารณาคุณสมบัติ และความเหมาะสม การยืนยันสิทธิในการเข้าร่วมและการได้รับรางวัลจากการเข้าร่วมกิจกรรมของท่าน ตามเงื่อนไขการจัดกิจกรรมที่ CFA Society Thailand อาจกำหนด (2) การติดต่อสื่อสารและประสานงานระหว่าง CFA Society Thailand และท่าน ระหว่างและหลังการจัดกิจกรรม (รวมถึงการสอบถามความพึงพอใจในการจัดกิจกรรม) (3) การจัดทำเอกสารบัญชีและภาษี (กรณีต้องจัดทำเอกสารภาษีสำหรับการชนะรางวัล) (4) การจัดทำสื่อประชาสัมพันธ์การจัดกิจกรรมที่ CFA Society Thailand ได้ดำเนินการ ผ่านช่องทางการติดต่อสื่อสารต่าง ๆ ของ CFA Society Thailand และของพันธมิตรที่ร่วมจัดกิจกรรม (5) การจัดทำสถิติ รายงานและการตรวจสอบการจัดกิจกรรมและการดำเนินงานต่าง ๆ ของ CFA Society Thailand ในรอบปี และ (6) กรณีที่ท่านให้ความยินยอม CFA Society Thailand อาจใช้ข้อมูลการติดต่อของท่านเพื่อการติดต่อประชาสัมพันธ์กิจกรรมอื่นของ CFA Society Thailand หรือของ CFA Institute ให้แก่ท่านในอนาคต
ระยะเวลาการประมวลผลข้อมูลส่วนบุคคล CFA Society Thailand สงวนสิทธิในการเก็บ รวบรวม ใช้ ประมวลผลและเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้ (i) ตลอดระยะเวลาที่จำเป็นในการจัดกิจกรรม และ 1 ปีปฏิทินภายหลังจากการจัดกิจกรรมเพื่อประโยชน์ในการตรวจสอบและจัดทำรายงานการจัดกิจกรรม (ii) ตลอดระยะเวลาตามกฎหมายที่ CFA Society Thailand มีหน้าที่ต้องดำเนินการ โดยเฉพาะตามรอบบัญชีและภาษี (iii) ในกรณีภาพถ่ายประชาสัมพันธ์ต่าง ๆ ทาง CFA Society Thailand จะเก็บรักษาและใช้สื่อประชาสัมพันธ์ดังกล่าวตลอดระยะเวลาที่จำเป็น โดยรับประกันไม่ให้กระทบสิทธิเจ้าของข้อมูลส่วนบุคคลเกินความจำเป็น
การส่งต่อเปิดเผยข้อมูลส่วนบุคคล CFA Society Thailand รับประกันการรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลของท่านโดยจะไม่เปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่บุคคลอื่น เว้นแต่เป็นการเปิดเผยให้แก่ผู้ให้บริการภายนอกที่ให้การบริการแก่ CFA Society Thailand ในการจัดกิจกรรมโดยตรง หรือให้แก่ CFA Institute หรือหน่วยงานราชการที่เกี่ยวข้องซึ่ง CFA Society Thailand อาจมีหน้าที่ต้องเปิดเผยข้อมูลส่วนบุคคลของผู้เข้าร่วมกิจกรรมไปยังหน่วยงานดังกล่าว ภายใต้ขอบเขตที่ CFA Society Thailand จะจำกัดขอบเขตการเปิดเผยข้อมูลเพียงเท่าที่จำเป็นเท่านั้น
นอกจากนี้ ด้วยจุดประสงค์ส่วนหนึ่งของการจัดกิจกรรมนี้ขึ้น CFA Society Thailand มีจุดประสงค์ที่สำคัญในการสร้างโอกาสใน การหางานให้แก่ ผู้เข้าร่วมกิจกรรม ดังนั้น CFA Society Thailand อาจเปิดเผยข้อมูลส่วนบุคคลของผู้เข้าร่วมกิจกรรมบางท่านให้แก่ บริษัทที่ให้ความสนใจจะว่าจ้างงานของท่านผู้เข้าร่วม โดย CFA Society Thailand จะเปิดเผยข้อมูลเพียงเท่าที่จำเป็นเท่านั้น และจะแจ้งให้ท่านผู้เข้าร่วมกิจกรรมที่เกี่ยวข้องทราบเกี่ยวกับการเปิดเผยข้อมูลส่วนบุคคลดังกล่าวที่จะมีการดำเนินการ และรับประกันไม่ให้กระทบสิทธิของท่านในฐานะเจ้าของข้อมูลมากเกินสมควร
สิทธิเจ้าของข้อมูลส่วนบุคคล หากท่านมีข้อสงสัยหรือต้องการใช้สิทธิใดเกี่ยวข้องกับข้อมูลส่วนบุคคลที่ท่านให้แก่ CFA Society Thailand ตามที่กำหนดไว้ภายใต้กฎหมายที่เกี่ยวข้อง ซึ่งอาจรวมถึงสิทธิในการขอเข้าถึงข้อมูลส่วนบุคคล สิทธิการคัดค้านการประมวลผลข้อมูลส่วนบุคคล สิทธิการขอลบหรือทำลายข้อมูล หรือสิทธิถอนความยินยอม ท่านสามารถติดต่อมายัง CFA Society Thailand ได้ที่ event@thailand.cfasociety.org
CFA Society Thailand (“CFA Society Thailand”) as the host of CFA Institute Research Challenge in Thailand (“Challenge”) would like to inform the participant to this Challenge that for the delivery of this Challenge, CFA Society Thailand would need to collect, use and process your personal data before, during and after the Challenge as defined below.
Personal Data to be Processed: refers to the personal data of all the team member that participate in the Challenge, including (1) full name; (2) resume that defines the education background, work experience and other qualifications of each team member; (3) contact information (i.e., telephone number and email); (4) other personal data that you may give CFA Society Thailand in the registration form or application form; (5) facial image, both portrait and video taken in the Challenge participation, either as the live broadcast or pre-recording session; provided that in should be noted that those photos shall be disclosed and shared to the public to ensure the transparency in hosting the Challenge; and (6) in case you win the Challenge, CFA Society Thailand would need to collect your identification document as the evidence.
In particular, for the photo taken during the Event, in case you do not want your photo taken, please feel free to let our staff know or please feel free to refuse; provided that the right to object or refuse shall not be applicable to the photos and records taken during the Challenge (for instance, audition or pitch video) that is one the pre-requisite conditions for the determination and selection of the Challenge winner and CFA Society Thailand, therefore, shall process and use such personal data in the host and delivery of the Challenge.
Purpose of the Personal Data Processing: CFA Society Thailand would need to process the defined personal data for the following purposes: (1) to confirm your eligibility to participate in the Challenge and select the winner of the Challenge as considered pursuant to the terms and conditions defined; (2) to coordinate and contact between CFA Society Thailand and you before and after the Challenge (including to request for your feedback); (3) to prepare the tax and accounting documentation (in particular for the Challenge winner); (4) to produce the marketing materials of the Challenge that CFA Society Thailand may distribute via various communication channels of CFA Society Thailand; (5) to prepare the statistic and report for the annual audit of all the activities and events hosted by CFA Society Thailand; and (6) with your consent, CFA Society Thailand may use your personal data to inform you of the upcoming events or any updates of CFA Society Thailand of CFA Institute in the future.
Retention Period: CFA Society Thailand reserves the right to process and retain your personal data within the following timeframe: (i) throughout period of time necessary for the Challenge arrangement and one calendar year after the end of the Event for the audit and reporting purposes; (ii) throughout the time prescribed under the laws CFA Society Thailand shall be subject to, in particular during the tax and audit period; and (iii) your photo used in the promotion materials shall be maintained for as long as it is necessary; provided that CFA Society Thailand commits not to cause excessive impact on your personal data and privacy than necessary.
Disclosure of Personal Data: CFA Society Thailand shall implement appropriate information security of your personal data and shall not disclose your personal data to any person, except the disclosure as necessary to the service provider engaged in the service provisions to CFA Society Thailand in relation to the Event; or to CFA Institute.
In addition, since one of the key objectives of the Challenge is to create job and employment opportunity for the Challenge participant, CFA Society Thailand may disclose your personal data to the employer who may interest in getting your profile; provided that CFA Society Thailand will only disclose the personal data on the necessary basis without causing excessive impact on your right and shall notify the relevant participant of such disclosure.
Data Subject Rights: In case you have any query or would like to exercise the rights relating to your personal data under the relevant laws, including without limitation the right to request for access, right to object to the personal data processing; right to request for the deletion of personal data; or the right to withdraw consent, please feel free to contact CFA Society Thailand at event@thailand.cfasociety.org
