ประกาศแจ้งการประมวลผลข้อมูลส่วนบุคคลของสมาคม ซีเอฟเอ ไทยแลนด์
สมาคม ซีเอฟเอ ไทยแลนด์ (“พวกเรา”) ให้ความสำคัญต่อความเป็นส่วนตัวและความปลอดภัยของข้อมูลส่วนบุคคลที่ สมาชิก CFA (ทั้งหมดเรียกรวมกันต่อไปนี้ว่า “ท่าน”) อาจให้แก่พวกเรา โดยประกาศแจ้งการประมวลผลข้อมูลส่วนบุคคลฉบับนี้ (“ประกาศ”) มีจุดประสงค์แจ้งให้ท่านทราบว่า พวกเราจะเก็บรวบรวม และรักษาข้อมูลส่วนบุคคล (ข้อมูลส่วนบุคคล") ของท่านอย่างไร และอธิบายถึงสิทธิเหนือข้อมูลส่วนบุคคลที่ท่านมี
ประกาศฉบับนี้ใช้กับ ข้อมูลส่วนบุคคลทั้งหมดที่พวกเราเก็บไม่ว่าจากช่องทางใด รวมถึงโดยเฉพาะผ่าน CFA Institute หรือเก็บรวบรวมจากกิจกรรม หรือการประชุม รวมถึงการติดต่อสื่อสารโดยตรงอื่นที่ท่านอาจมีกับพวกเรา
การยอมรับประกาศ
เมื่อท่านขึ้นทะเบียนกับ CFA Institute และส่งข้อมูลส่วนบุคคลของท่านให้แก่ CFA Institute และจะถูกส่งต่อมายังพวกเรา หรือเมื่อท่านเข้าเยี่ยมชมเว็บไซต์ของพวกเรา หรือติดต่อพวกเรา และให้ข้อมูลส่วนบุคคลของท่านแก่พวกเรา พวกเราจะถือว่า ท่านยอมรับและตกลงว่า ข้อมูลส่วนบุคคลของท่านจะได้รับการประมวลโดยสอดคล้องกับประกาศฉบับนี้
แหล่งที่มาของข้อมูลส่วนบุคคล
โดยหลัก พวกเราจะได้รับข้อมูลส่วนบุคคลของท่านจาก CFA Institute (ผ่านการขึ้นทะเบียนรับการฝึกอบรมใด ๆ กับ CFA Institute รวมถึงการลงทะเบียนเข้าร่วม CFA Program หรือโครงการให้ความรู้อื่น หรือผ่านการสมัครเป็นสมาชิก) ซึ่ง CFA Institute จะเปิดให้พวกเราสามารถเข้าถึงข้อมูลส่วนบุคคลของท่านได้ เพื่อประโยชน์ในการติดต่อประสานงานในการสร้างชุมชนของสมาชิก หรือ พวกเราอาจได้รับข้อมูลส่วนบุคคลของท่านมาจากท่านโดยตรง จากการติดต่อประสานงานภายหลังจากนั้น ไม่ว่าด้วยรูปแบบอิเล็กทรอนิกส์หรือด้วยการให้ข้อมูลเป็นเอกสารกระดาษ
พวกเราอาจได้รับข้อมูลส่วนบุคคลของท่านด้วยระบบอัตโนมัติ ผ่านการใช้คุกกี้หรือเทคโนโลยีอื่น และในบางกรณีจากบุคคลภายนอก เช่น บริษัทที่การสนับสนุนการจัดกิจกรรม หรือการประชุมซึ่งพวกเราเข้าร่วมเพื่อประโยชน์ของท่าน
ข้อมูลส่วนบุคคลที่พวกเราเก็บรวบรวม
ข้อมูส่วนบุคคลดังที่ระบุด้านล่างนี้ เป็นข้อมูลส่วนบุคคลที่พวกเราเก็บรวบรวม:
1. ชื่อนามสกุล และข้อมูลการติดต่อ (ได้แก่ เบอร์โทรศัพท์ อีเมล ที่อยู่)
2. ข้อมูลทั่วไปอื่น ได้แก่ เพศ วันเดือนปีเกิด ข้อมูลหนังสือเดินทาง ข้อมูลประวัติการศึกษาและประวัติการทำงาน
3. เลขรหัสสมาชิก CFA Institute และข้อมูลเกี่ยวกับระดับสมาชิก
4. ข้อมูลทางการเงิน ซึ่งรวมถึงแต่ไม่จำกัดเพียงข้อมูลบัตรเครดิต
5. ข้อมูลพฤติกรรมการใช้เว็บไซต์ ข้อมูลระบุตัวตนทางเทคนิคอื่น เช่น IP Address หรือรหัสโทรศัพท์มือถือ รายละเอียดเบราว์เซอร์หรือระบบปฏิบัติการของเครื่องที่ใช้เชื่อมโยงกับระบบ และข้อมูลคุกกี้ และ
6. ข้อมูลส่วนบุคคลอื่นที่ท่านอาจให้แก่พวกเราในการติดต่อสื่อสาร หรือระหว่างการเข้าร่วมกิจกรรมที่พวกเราจัดขึ้น และท่านเข้าร่วม ซึ่งอาจรวมถึงข้อมูลการติดต่อสอบถาม ความเห็น และข้อมูลความสนใจอื่น
วัตถุประสงค์ในการประมวลผลข้อมูลส่วนบุคคล
พวกเราจะประมวลผลข้อมูลส่วนบุคคลของท่าน เพื่อช่วยให้พวกเราเข้าใจความต้องการของท่านได้มากขึ้น เพื่อให้บริการที่มีประสิทธิภาพและตรงกับความต้องการของท่าน และเพื่อวัตถุประสงค์อื่นที่ระบุไว้ในประกาศฉบับนี้ ทั้งนี้ ฐานกฎหมายที่พวกเราอ้างอิงสำหรับการประมวลผลข้อมูลส่วนบุคคลของท่าน ได้แก่
1. เพื่อการปฏิบัติหน้าที่ตามสัญญา ซึ่งพวกเราจำเป็นต้องประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อการปฏิบัติหน้าที่และความรับผิดชอบของพวกเรา ที่ท่านอาจร้องขอจากพวกเรา หรือที่พวกเราตกลงจะปฏิบัติให้ และจัดหาให้แก่ท่าน ทั้งนี้ รายละเอียดวัตถุประสงค์การประมวลผลข้อมูลส่วนบุคคล มีดังนี้:
(a) เพื่อให้ข้อมูลเกี่ยวกับพันธกิจ และหน้าที่ความรับผิดชอบของพวกเราตามที่ท่านอาจร้องขอ
(b) เพื่อสื่อสาร และประสานงานในการจัดกิจกรรมระหว่างสมาชิก ในฐานะที่พวกเราเป็นเจ้าภาพดูแลสมาชิก CFA Institute ในประเทศไทย ซึ่งพวกเรามีความมุ่งมั่นที่จะช่วยเหลือท่าน ในฐานะสมาชิก ให้สามารพัฒนาและเติบโตในสายงาน โดยพวกเราจะติดต่อประสาน งานในฐานะที่เป็นช่องทางที่มีประสิทธิภาพในการเชื่อมโยงระหว่างบรรดาสมาชิก หน่วยงานกำกับดูแล และผู้เล่นในตลาดที่เกี่ยวข้องทั้งหมด
เพื่อจุดประสงค์การสื่อสารนี้ พวกเราอาจประมวลผลข้อมูลส่วนบุคคลของท่าน เพื่อติดต่อและแจ้งให้ท่านทราบเกี่ยวกับกิจกรรมที่จัดขึ้นในบรรดาสมาชิก หรือข้อมูลข่าวสารจาก CFA Institute ที่ท่านอาจสนใจ แต่ด้วยความเคารพในสิทธิความเป็นส่วนตัวของท่าน พวกเราเปิดให้ท่านสามารถระบุเลือกช่องทางการติดต่อ เพื่อรับข้อมูลข่าวสารดังกล่าวจากพวกเราได้
(c) เพื่อตรวจสอบคุณสมบัติและสถานะการเป็นสมาชิกของท่าน โดยสอดคล้องกับข้อกำหนดของ CFA Institute หรือเอกสารกฎระเบียบอื่นที่ระบุไว้ ก่อนที่จะเปิดให้ท่านเข้าร่วมกิจกรรมเฉพาะของสมาชิก ซึ่งพวกเราอาจจัดขึ้นและท่านอาจสนใจเข้าร่วม และ
(c) เพื่อให้บริการและการสนับสนุนอื่น ผ่านเว็บไซต์ และ/หรือช่องทางการติดต่ออื่นที่ท่านอาจติดต่อขอมายังพวกเรา ซึ่งรวมถึงแต่ไม่จำกัดเพียง เพื่อการประสานงานและติดต่อการเข้าร่วมกิจกรรมที่ท่านอาจสนใจดำเนินการ ซึ่งอยู่ภายใต้กรอบพันธกิจของพวกเรา
2. เพื่อการปฏิบัติหน้าที่ตามกฎหมาย ซึ่งพวกเราอาจต้องปฏิบัติตาม และพวกเราอาจจำเป็นต้องประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อการ ปฏิบัติหน้าที่ที่ระบุไว้ดังกล่าว ซึ่งรวมถึงแต่ไม่จำกัดเพียง การจัดทำเอกสารบัญชีและภาษี ซึ่งพวกเราอาจมีหน้าที่ต้องดำเนินการภายใต้กรอบกฎหมายบัญชีและภาษี
3. เพื่อการใช้และปกป้องคุ้มครองสิทธิอันชอบด้วยกฎหมาย ซึ่งพวกเราจะดำเนินการทบทวนกระบวนการประมวลผลข้อมูลส่วนบุคคลนั้น โดยพิจารณาผลประโยชน์และสิทธิขั้นพื้นฐานของท่าน ในฐานะเจ้าของข้อมูลส่วนบุคคล รวมถึงประเมินการประมวลผลข้อมูลส่วนบุคคลกับความคาดหมายที่ท่านอาจมี ภายใต้เงื่อนไขที่ว่า หากพวกเราเชื่อว่า ผลประโยชน์หรือสิทธิขั้นพื้นฐานของท่านมีเหนือผลประโยชน์อันชอบด้วยกฎหมายของพวกเรา พวกเราจะหาฐานวัตถุประสงค์ในการประมวลผลข้อมูลส่วนบุคคลดังกล่าว หรือจะงดเว้นจากการประมวลผลข้อมูส่วนบุคคลดังกล่าว ทั้งนี้ เพื่อประโยชน์อันชอบด้วยกฎหมายดังกล่าว พวกเราจะประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ย่อย ดังนี้:
(a) เพื่อเก็บสถิติเกี่ยวกับการใช้เว็บไซต์และช่องทางการติดต่อสื่อสารอื่นของพวกเรา และ/หรือสถิติกิจกรรมที่จัดขั้น และเพื่อใช้ข้อมูลส่วนบุคคลดังกล่าวเพื่อการวิเคราะห์ข้อมูลที่ดำเนินการไปเพื่อวัตถุประสงค์การปรับปรุงการให้บริการและกิจกรรมที่จัดให้แก่ สมาชิก และ/หรือการปรับปรุงช่องทางการติดต่อสื่อสารของพวกเรา
(b) เพื่อติดตาม ตรวจสอบและสอบทานเหตุทุจริต หรือธุรกรรมต้องสงสัย โดยจะดำเนินการสอดคล้องกับกรอบการบริหารจัดการความเสี่ยงที่ CFA Instituted และ/หรือพวกเราอาจกำหนดขึ้น และ
(c) เพื่อบริหารจัดการและแก้ไขข้อร้องเรียนที่ท่านอาจมีต่อพวกเรา และที่พวกเราอาจต้องบังคับกับท่าน
4. อ้างอิงความยินยอม ที่ท่านอาจให้แก่พวกเราในการประมวลผลข้อมูลส่วนบุคคล เพื่อวัตถุประสงค์เฉพาะ พวกเราอาจประมวลผลข้อมูลส่วนบุคคลของท่านตามวัตถุประสงค์ที่ท่านให้ความยินยอมแก่ พวกเรา โดยเฉพาะพวกเราอาจติดต่อกับท่านเพื่อแจ้งให้ท่านทราบเกี่ยวกับข้อมูลส่วนอื่นที่นอกเหนือจากกิจกรรมของสมาชิกที่พวกเรา หรือพันธมิตรของเราอาจจัดให้ ซึ่งอาจตรงกับความสนใจของท่าน
พวกเราของแจ้งให้ทราบว่า หากพวกเราประมวลผลข้อมูลส่วนบุคคลของท่านบนพื้นฐานความยินยอม ท่านมีสิทธิในการถอนความยินยอมได้ไม่ว่าเวลาใด โดยที่การถอนความยินยอมดังกล่าวต้องไม่กระทบต่อการดำเนินการใดที่ทำไปแล้วก่อนหน้าการถอนความยินยอมนั้น
ในกรณีที่ท่านไม่ให้ข้อมูลส่วนบุคคลใดแก่พวกเราในการประมวลผล เพื่อวัตถุประสงค์ที่ระบุไว้ในประกาศฉบับนี้ ท่านอาจไม่มีสิทธิได้รับการบริการ หรือการสนับสนุนจากพวกเราในบางส่วน
ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคลของท่าน
พวกเราจะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้ตราบเท่าที่มีความจำเป็นตามสมควรในการปฏิบัติตามวัตถุประสงค์ ที่พวกเราใช้ในการเก็บรวบรวม ข้อมูลส่วนบุคคลของท่านตามที่กำหนดไว้ในประกาศฉบับนี้ (โดยเฉพาะตลอดระยะเวลาที่ท่านยังเป็นสมาชิก CFA members และระยะเวลาเพิ่ม เติมที่พวกเราอาจสงวนสิทธิในการเก็บข้อมูลส่วนบุคคลของท่านไว้ต่อเนื่อง เพื่ออำนวยความสะดวกกรณีที่ท่านกลับมาสมัครสมาชิกอีกครั้ง) ภายใต้เงื่อนไขที่ว่า พวกเราอาจเก็บรักษาข้อมูลส่วนบุคคลของท่านเป็นระยะเวลายาวนานกว่านั้น หากเป็นกรณีที่กำหนดไว้ในกฎหมายที่เกี่ยวข้อง
การเปิดเผยข้อมูลส่วนบุคคล
โดยหลัก พวกเราจะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เป็นความลับที่สุด แต่อย่างไรก็ตาม พวกเราอาจจำเป็นต้องเปิดเผยข้อมูลส่วนบุคลของท่านให้แก่ บุคคลดังนี้ (1) CFA Institute และสมาคม CFA ในประเทศอื่นที่ท่านอาจเลือกที่จะสมัครเข้าร่วมสมาคมนั้น (2) บุคคลภายนอกที่พวกเราว่าจ้างเพื่อการปฏิบัติหน้าที่เกี่ยวข้องกับการให้การสนับสนุนแก่ท่าน และว่าจ้างให้ช่วยในการดำเนินการของพวกเรา (3) หน่วยงานภาครัฐที่พวกเราอาจมีหน้าที่ตามกฎหมาย กฎระเบียบ หรือคำสั่งของศาลหรือหน่วยงานกำกับดูแลต้องเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่หน่วยงานดังกล่าว และ (4) บุคคลอื่นใดที่ท่านอาจให้ความยินยอมแก่พวกเราในการเปิดเผยให้แก่บุคคลนั้น
การรับประกันการรักษาความลับ. ในกรณีที่พวกเราจำเป็นต้องเปิดเผยข้อมูลของท่านให้แก่บุคคลภายนอก พวกเราจะรับประกันปกป้องรักษาข้อมูลส่วนบุคคลของท่าน ด้วยข้อกำหนดการรักษาความลับ การดำเนินมาตรการรักษาความมั่นคงปลอดภัย ตามขอบเขตที่กฎหมายที่เกี่ยวข้องกำหนด และพวกเราจะเปิดเผยข้อมูลส่วนบุคคลของท่าน เฉพาะกรณี และขอบเขตเท่าที่จำเป็นเท่านั้น
การส่งต่อข้อมูลไปต่างประเทศ. เพื่อวัตถุประสงค์ที่ระบุไว้ข้างต้นในประกาศฉบับนี้ทั้งหมด พวกเราอาจต้องเปิดเผยและส่งต่อข้อมูลส่วนบุคคลของท่าน ให้แก่บุคคลภายนอก หรือเซอร์เวอร์ที่ตั้งอยู่นอกประเทศไทย ซึ่งประเทศปลายทางนั้นอาจมีหรืออาจไม่มีมาตรฐานการรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลเท่ากับประเทศไทย ซึ่งในกรณีที่ข้อมูลส่วนบุคคลของท่าจะถูกส่งต่อไปต่างประเทศดังกล่าว พวกเราจะดำเนินกระบวนการทั้งหมดในการรับประกันว่า ข้อมูลส่วนบุคคลของท่านจะได้รับการส่งต่อเปิดเผยอย่างปลอดภัย และผู้รับข้อมูลส่วนบุคคลดังกล่าวต้องมีมาตรฐานในการรักษาคุ้มครองข้อมูลส่วนบุคคลพร้อม รวมถีงพวกเราจะดำเนินการโอนภายใต้กรอบที่กฎหมายที่เกี่ยวข้องกำหนด
การรักษาความมั่นคงปลอดภัย
พวกเราจะดำเนินมาตรการที่เหมาะสมทางด้านเทคนิค กายภาพและบริหารในการปกป้องรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลของท่าน โดยการเข้าถึงข้อมูลส่วนบุคคลของท่านจะถูกจำกัดเฉพาะพนักงาน ผู้รับจ้าง หรือตัวแทนที่มีอำนาจของพวกเรา ซึ่งได้รับการมอบหมายและมอบอำนาจเฉพาะเท่านั้น และข้อมูลที่จะอนุญาตให้เข้าถึงดังกล่าวจะถูกจำกัดเพียงเท่าที่จำเป็นในการปฏิบัติหน้าที่และวัตถุประสงค์ที่ระบุไว้สำหรับการประมวลผลข้อมูลส่วนบุคคลดังกล่าวเท่านั้น
สิทธิของท่าน
ภายใต้กรอบกฎหมายที่เกี่ยวข้อง และข้อยกเว้นที่ถูกกำหนดไว้ ท่านย่อมมีสิทธิในข้อมูลส่วนบุคคลของท่าน ดังนี้ (1) สิทธิในการได้รับแจ้งเกี่ยวกับการประมวลผลข้อมูล (2) สิทธิในการเข้าถึง (3) สิทธิในการขอให้มีการโอนหรือย้ายข้อมูลส่วนบุคคลที่มีการเก็บในรูปแบบอิเล็กทรอนิกส์ที่สามารถโอนย้ายได้โดยอัตโนมัติ เว้นแต่เป็นกรณีที่มีข้อจำกัดทางเทคนิค (4) สิทธิในการคัดค้านในการประมวลผลข้อมูลในกรณีเฉพาะที่พวกเราใช้สิทธิโดยชอบด้วยกฎหมายในการประมวลผลข้อมูลส่วนบุคคลดังกล่าว (5) สิทธิในการแก้ไขข้อมูลส่วนบุคคลของท่านให้ถูกต้องและเป็นปัจจุบัน (6) สิทธิในการขอให้ลบหรือทำลายข้อมูลส่วนบุคคล ที่พวกเราประมวลผลข้อมูลส่วนบุคคลนั้นอยู่ (7) สิทธิในการระงับการประมวลผลข้อมูลส่วนบุคคล (8) สิทธิในการถอนความยินยอม และ (9) สิทธิในการร้องเรียน
การติดต่อสื่อสารกับพวกเรา
ถ้ากรณีที่ท่านมีข้อเรียกร้องคำถาม มีความคิดเห็น หรือต้องการใช้สิทธิของท่านในส่วนที่เกี่ยวข้องกับข้อมูลส่วนบุคคลภายใต้กฎหมาย ท่านสามารถติดต่อพวกเราได้ที่ event@thailand.cfasociety.org.

CFA Society Thailand Privacy Policy
CFA Society Thailand (“We”) gives high priority to the privacy and the security of the personal information that the CFA candidates and You (collectively referred to as the “You”) may provide to us. This Privacy Notice (the “Notice”) that describes how we gather and protect individually identifiable information ("Personal Information"); and describes your Personal Information privacy rights, therefore, has been announced to inform You.
This Notice applies to all the Personal Information that we collect through any means, including, in particular from the CFA Institute, events and conferences and any other direct interactions between us.
Acceptance of the Notice
Upon your registration with CFA Institute where your Personal Information will be shared by CFA Institute to us; your use of our website; your contact to us; or once You provide any Personal Information to us, we shall deem that You acknowledge and accept that your Personal Information will be processed according to this Notice.
Sources of Personal Information
Generally, we obtain your Personal Information from the CFA Institute (through the registration for any CFA Institute educational offering, including the CFA Program or any of our other professional learning programs or the member enrollment) who will share the access to your Personal Information to us for further coordination in building members and candidates communities or directly from you during the subsequent coordination or communication, either electronically or by providing hard copies of documents.
We may also obtain the Personal Information automatically, through the use of cookies and other technologies, and in some instances from third parties, such as companies that sponsor programs or conferences in which We participate in for your benefits.
Personal Information We Collect
Listed below are the Personal Information that we collect:
1. Full name and personal contact information (phone, email address, physical address);
2. General information, including gender, birthdate, passport information, education and work background;
3. CFA Institute ID and the relevant member tiers and information;
4. Financial information, including without limitation the credit card information
5. Behavioral data on our website; other online identifiers (i.e., IP Address or Mobile Device ID, browser and operating system types); and cookies; and
6. Any other Personal Information that You may provide to us in any communication or contact made or any event participation that we may host and You may participate, including your query, comments or request made and the interest information.
Purposes of Personal Information Processing
We process your Personal Information to help us better understand your needs, to provide You with personalized and efficient service, and for other purposes described in this Notice. Our bases for processing your Personal Information are:
1. Contractual Basis where We are obligated to process your Personal Information to carry out any obligations or responsibilities that You are requesting from us or that We commit to perform and provide to You, including in particular the following detailed purposes:
(a) to respond to your request for information and inputs relating to our functions and commitment;
(b) to communicate, and facilitate any networking event and collaboration as a local member society of CFA Institute, strives to assist You as the members and candidates in your career development, including without limitation by becoming an effective channel of communication between members, regulators and other market participants;
For this particular purpose, We may process your Personal Information to contact and inform You of any community events or CFA Institute news and updates that may be of your interest yet We respect your privacy rights to customize your preference in defining the information that You may wish to obtain from us.
(c) to verify your qualifications and membership status pursuant to CFA Institute Charter and other relevant document defined prior to your acceptance to any member-exclusive events that We may host and You may participate in; and
(c) to provide You with our services and support through our website and/or other communication channels that You may request from us, including without limitation to coordinate and facilitate any events as You wish to execute and transact that fall under our principal objectives.
2. Legal or regulatory obligations where We need to comply with the legal or regulatory obligations that We are subject to and We would then need to process your Personal Information to satisfy those obligations, including without limitation to proceed with the tax documentation as We may be obliged under the tax and accounting laws to perform
3. Legitimate Interests where We will review our processing in light of the interests and fundamental rights and freedoms of You as the data subject taking into account your reasonable expectations; provided that where We believe those interests or fundamental rights and freedoms override our legitimate interests, We will seek another valid basis for processing your Personal Information or refrain from that processing activity. For this particular lawful basis, We will process your Personal Information for the following detailed purposes:
(a) to keep statistics relating to the use of our website as well as other communication channels and/or other event hosted and to use those Personal Information for data analysis carried out for the improvement and upgrade of the supports and community event and/or the communication channels that We may have;
(b) to monitor, detect and audit any fraud or any suspicious transaction executed pursuant to the risk management and framework that CFA Instituted and/or We may set and define; and
(c) to manage any complaint that You may have brought against us or We may need to enforce against You.
4. Consent that You may give to us to process for any specific objectives, We will proceed in processing your Personal Information accordingly, in particular We may contact You to update or inform You of any other information that are in addition to the member or candidate events either hosted by us or our partners that may suit your interests.

Retention Period of your Personal Information
We will retain your Personal Information for as long as it is reasonably necessary to fulfill the purposes for which We have obtained your Personal Information as set out in this Notice (in particular so long as you remain the CFA members and/or candidates and for additional period of time that We may reserve the right to retain your Personal Information to facilitate your re-enrollment); provided that We may have to retain your personal data for a longer period, if required by any applicable laws.
Disclosure of Personal Information
Generally, We would retain your Personal Information in strict confidence; however, We may need to disclose your Personal Information to the following parties: (1) CFA Institute and any other CFA membership society that You may opt-in to be their community members; (2) Third parties that We engage to perform services in connection with the performance of our support to You and our operation; (3) Government authorities where We may be obliged by any of the applicable laws, regulations, rules or by any order of courts or other competent authorities to disclose your Personal Information to; and (4) Any person that You may give consent to us to disclose your Personal Information to.
Confidentiality Arrangement. For the case where your Personal Information is being disclosed to other third-parties, We will ensure the protection of your Personal Information, such as confidentiality arrangement, appropriate security measures to the extent as required by laws and We will only disclose your Personal Information on a necessary and need-to-know basis.
Cross-border Transfer. For the purposes mentioned above in this Notice, We may disclose or transfer your Personal Information to third parties or servers located overseas which the destination countries may or may not have the same data protection standards as Thailand; provided that in all circumstances that your Personal Information will be shared abroad, We will take steps and measures to ensure that your Personal Information is securely transferred, that the data recipients have suitable data protection standards in place, and that the transfer is in compliance with the applicable laws.
Security
We maintain reasonable and appropriate technical, physical, and administrative measures to protect the security of your Personal Information. Access to Personal Information is limited to only those employees, contractors, or authorized agents of us who have authorization to access such Personal Information and such access is limited to the extent such information is needed to fulfill the task for which the Personal Information was collected.
Your Rights
Subject to applicable laws and exceptions thereof, your Personal Information rights include: (1) Right to Be Informed; (2) Right to Access; (3) Right to Data Portability for the case where we have an automated platform allowing you to access your Personal Information automatically, with the exceptions of cases where there are technological limitations; (4) Right to Object to any data processing activity of your Personal Information in certain circumstances that We may exercise our legitimate rights to process your personal data;(5) Right to Edit your Personal Information to be correct and up to date; (6) Right to request the deletion or anonymization of your Personal Information that We process about you; (7) Right to restrict any Personal Information processing activities; (8) Right to Withdraw Consent; and (9) Right to Lodge any complaint.
